কোন ভুক্তভোগীর অভিযোগের বিষয়ে সংশ্লিষ্ট কর্তৃপক্ষ যদি দ্রুত পদক্ষেপ ও যথাযথ ব্যবস্থা গ্রহণ করে সেক্ষেত্রে একদিকে যেমন অনেক অনাকাঙ্খিত পরিস্থিতি এড়ানো সম্ভব হবে, অন্যদিকে ভুক্তভোগীদের মানসিক যাতনা, আর্থিক ক্ষতি এবং আদালতের দ্বারস্থ হওয়া থেকে রেহাই দেয়াও সম্ভব হবে।. . . . . . . . . . . . . . . . . . . . . . . সে কারণে, আদালত প্রত্যাশা করে যে, পুলিশসহ আইনশৃঙ্খলা বাহিনীর সদস্যদের বিরুদ্ধে কোন অভিযোগ উত্থাপিত হলে ঐ অভিযোগ সম্পর্কে দ্রুততার সাথে বিভাগীয় তদন্ত সম্পন্ন এবং দোষী প্রমাণিত হলে দ্রুত আইনানুগ (বিভাগীয়/ফৌজদারী) পদক্ষেপ গ্রহণ করা প্রয়োজন। আদালতের এ প্রত্যাশা বিবেচনায় নিয়ে মহা-পুলিশ পরিদর্শক এ বিষয়ে প্রয়োজনীয় কার্যকর ব্যবস্থা গ্রহণ এবং ‘আইজিপি কমপ্লেইন্টস্ মনিটরিং সেল’র কার্যক্রমকে আরো কার্যকর ও গতিশীল করবেন মর্মে আদালতের দৃঢ় বিশ্বাস।

The main criteria for constituting an offence under section 57 of the Act is that the fake or obscene information/comments or materials shall have to be published or transmitted for public in general in the website or electronic form, not for any particular individual. Accordingly, we can safely conclude that mere sending obscene or fake information through SMS from one’s cellular phone to another individual’s cellular phone cannot be construed as a publication or transmission for public in general and hence, does not constitute an offence under section 57 of the ICT Act.

at the investigation stage the investigation officer has no authority to adjudicate on the propriety or credibility of a statement made by an accused under section 164 of the Code of Criminal Procedure. It has to be taken into consideration by the investigating officer as it is. It is the duty of the trial judge to examine and asses the truth, veracity and voluntariness of a statement under section 164 of the Code of Criminal Procedure made by an accused. An investigating officer cannot steps into the shoes of a trial judge.
