Natabaria Zoller Kandipara Matshozibi Shamobay Samity Ltd. vs Bangladesh and others.

In other words, registration and Identification Card are issued to the applicant concerned by the authority concerned after due scrutiny under the Guidelines, 2019 for identification of the fishermen whose sole livelihood is catching fish and selling those in the local market. Despite the fact that “সরকারী জলমহালব্যবস্থাপনা নীতি-২০০৯” does not prescribe the Samity to have members who are required to have registration and Identification Card issued under the Guidelines, 2019 but said Identification Card, no doubt, plays a vital role for identification of ``প্রকৃত মৎস্যজীবি"
In the absence of the said Fishermen Identification Card of all its respective members the respondent No.7, however, has failed to produce the report and the findings of the concerned Deputy Commissioner so have been forwarded to the Ministry concerned under Clause 7(2) to show that its respective members are ``প্রকৃত মৎস্যজীবি", for, basing on the said report the Ministry is to give its final decision under Clause 7(5).
In the absence of the said report and findings of the Deputy Commissioner when the respective committee concerned has opined with regard to respondent No.7 that “সমিতির সকল সদস্য প্রকৃত মৎস্যজীবী নয়”, taking the impugned decision by the Ministry concerned to grant lease in favour of the respondent No.7 cannot be mandated as lawful.
