“It appears that Chapter XVIIA was inserted by Section 2 of the State Acquisition and Tenancy (Amendment) Act, 2004 (Act No. IX of 2004) providing for establishment of Land Survey Tribunals and Land Survey Appellate Tribunals in Bangladesh. In the meantime, Land Survey Tribunals consisting of Joint District Judges have been established across the country. But unfortunately as per Section 145B of the State Acquisition and Tenancy Act, 1950, no Land Survey Appellate Trivunal has yet been constituted by the Government by any notification in the Official Gazzette. Consequently, thousands of parties aggrieved by the judgments, decrees or orders of the Land Survey Tribunals have been rushing to the High Court Division to invoke its writ jurisdiction under Article 102 of the Constitution

for necessary legal redress. By this time, the High Court Division has already been flooded with writ petitions in this regard. One of such writ petitions being Writ Petition No. 1438 of 2015 has been filed and while passing the initial order of Rule Nisi, the non-constitution of any Land Survey Appellate Tribunal has come to our notice. Besides, the learned Deputy Attorney-General Mr. Md. Motaher Hossain (Sazu) and the learned Advocate appearing for the petitioner Mr. Md. Mainul Islam have also confirmed that no gazette notification has been made by the Government to establish any Land Survey Appellate Tribunal within the territorial limits of Bangladesh as yet since 2004. It is a great public concern. What is more, the plethora of such writ petitions is compounding the problem of logjam of cases in the High Court Division. In order to tide over this situation and in public interest, we think, the Government should establish as many Land Survey Appellate Tribunals as may be required to hear the appeals arising out of the judgements, decrees or orders of the Land Survey Tribunals. Accordingly, we are inclined to issue a Suo Motu Rule in this behalf.
So let a Suo Motu Rule Nisi be issued calling upon the Secretary, Ministry of Land, Bangladesh Secretariat, Dhaka and the Secretary, Ministry of Law, Justice and Parliamentary Affairs, Bangladesh Secretariat, Dhaka to show cause as to why they should not be directed to establish as many Land Survey Appellate Tribunals as may be required to hear the appeals arising out of the judgements, decrees or orders of the Land Survey Tribunals in Bangladesh by notifications in the Official Gazette at an early date and/or such other or further order or orders passed as to this Court may seem fit and proper.
The Rule is returnable within 2(two) weeks from date.

“We have heard the learned Deputy Attorney General Mr. Md. Motaher Hossain (Sazu) and perused the record.
It transpires that a Suo Motu Rule Nisi was issued on 03.03.2015 calling upon the Secretary, Ministry of Land, Bangladesh Secretariat, Dhaka and the Secretary, Ministry of Law, Justice and Parliamentary Affairs, Bangladesh Secretariat, Dhaka to show cause as to why they should not be directed to establish as many Land Survey Appellate Tribunals as may be required to hear the appeals arising out of the judgments; decrees or orders of the Land Survey Tribunals in Bangladesh by notifications in the Official Gazette at an early date. Although nearly 10 (ten) months have already elapsed since the issuance of the Rule Nisi, no concrete steps have yet been taken for establishment of Land Survey Appellate Tribunals in Bangladesh by notifications in the Official Gazette. This is, no doubt, a matter of concern to us. However, the materials on record show that the Government is contemplating to amend the relevant provisions of the State Acquisition and Tenancy Act, 1950 with a view to appointing the Judges of the Land Survey Appellate Tribunals from amongst District Judges or retired District Judges (vide Annexure-‘B’ to the Affidavit-of- Compliance submitted on behalf of the respondent No. 1 Secretary, Ministry of Land, Bangladesh).
What is worrisome is that because of non-existence of Land Survey Appellate Tribunals, Writ Petitions are being filed in the High Court Division under Article 102 of the Constitution challenging the legality of the judgments passed by the Land Survey Tribunals across the country compounding the problem of backlog of cases of the High Court Division. If the Government decides to take necessary steps for amendment of the relevant provisions of the State Acquisition and Tenancy Act, 1950 for establishment of Land Survey Appellate Tribunals to be manned by District Judges or retired District Judges; in that event, the decision should be taken as expeditiously as possible in public interest. The unnecessary dilly-dallying with the matter by the Government in this regard is causing hardship to the litigant people. In such a scenario, we are inclined to defer the hearing of the Suo Motu Rule for a reasonable time in order to enable the Government to take necessary steps in respect of establishment of Land Survey Appellate Tribunals throughout the country. That being so, let the hearing of the Suo Motu Rule be adjourned to 15.02.2016.
Anyway, we direct the learned Deputy Attorney – General Mr. Md. Motaher Hossain (Sazu) to follow up the matter with the top brass of the Government.
