In the instant civil revisional application, this Court on 04.06.2023 issued a Rule calling upon the opposite party Nos. 1 to 3 to show cause as to why the judgment and order dated 13.10.2022 passed by the learned Additional District Judge, 4th Court, Chattogram in Miscellaneous Appeal No. 05 of 2019 allowing the appeal and granting ad-interim injunction in favour of the plaintiffs restraining the defendants from interfering with the peaceful possession of the plaintiffs in the suit land described in schedule 1(Ka), from dispossessing the plaintiffs from the said land, from changing the nature and character of the land in question and from transferring the

land to 3rd party till disposal of the suit and thereby rejecting the order No. 23 dated 07.11.2018 passed by Senior Assistant Judge, Rangunia Adalat, Rangunia Chouki, Chattogram in Partition Suit No. 46 of 2017 rejecting the application for temporary injunction filed by the plaintiffs should not be set aside.
At the time of the issuance of the Rule, this Court passed an ad- interim order staying operation of the judgment and order of injunction dated 13.10.2022 passed in the miscellaneous appeal and further directed the parties to maintain status quo in respect of possession and position of the suit land.
Mr. M. Belayet Hossain, the learned Advocate appearing for the opposite party Nos. 1-3, frankly and candidly submits that he has no objection to the ad-interim order of status quo passed by this Court at the time of issuance of the Rule.
In view of the submission of the learned Advocate appearing for the opposite party Nos. 1-3, the parties are directed to maintain status quo in respect of possession and position of suit land till disposal of the suit.
With above observations and directions the Rule is disposed of. Send down the LCR at once.
