“This is an application for correction of the order dated 05.06.2007.

Heard the learned Advocate for the petitioners and perused the application.

In the application it is stated that the petitioner prays in prayer (a) as under:

“Issue  a Rule Nisi issue calling upon the respondents to show cause as to why the failure of the respondents to implement the decision communicated under Memo No. Shakha-6/5L-1/81/29 dated 12.10.1992 issued by the respondent No.3 to the predecessor of the petitioners (Annexure-“A”) shall not be declared to have been done without any lawful authority and to be of no legal effect and why the respondents shall not be directed to hand over possession and execute lease deed in respect of 1 bigha of land out of 3 bigha of land situated in Plot No. 246 of Tejgaon Industrial Area, Dhaka in favour of the petitioners”.

It is also stated that the Rule Nisi issued on the following terms:

“Let the supplementary affidavit do form part of the main application and a Rule Nisi issue calling upon Respondents to show cause as to why the impugned memo No. Shakha-6/5L-1/81/29 dated 12.01.1992 (Annexure-“A”) issued by the respondent No.3 should not be declared to have been issued without lawful authority and to be of no legal effect and/or such other or further order or orders passed as to this Court may seem fit and proper.”

If the prayer of the writ petition and order issuing the Rule Nisi are considered in juxtaposition we find that the Rule Nisi was not issued as per the prayer (a). Therefore, the Rule dated 5.6.2007 is recalled and a fresh Rule be issued as per the prayer (a) as under:

 Accordingly, the appeal is allowed. The impugned judgment and order of the High Court Division in Review Petition No. 04 of 2009 and the judgment and order passed in Writ Petition No. 10371 of 2006 are set aside and the writ petition is sent back to the High Court Division for hearing afresh and for disposal in accordance with law giving chance to the writ respondents to file affidavit-in-opposition.”

National Engineers vs. Ministry of Defence [44 DLR (AD) (1992) 179] B¢fm ¢hi¡N ¢pÜ¡¿¹ fËc¡e L−le ®k,

“In order to enforce the performance by public bodies of any public duty by mandamus, the applicant must have a specific legal right to insist upon such performance”.

So, a writ of mandamus can be granted only in a case where there is a statutory duty imposed upon the public bodies and there is a failure on the part of that public bodies to discharge their statutory obligations. The paramount function of a writ is to compel performance of public duties prescribed by statute and to keep public bodies exercising public functions within the limits of their jurisdiction. Therefore, mandamus may issue to compel the public bodies to do something, it must be shown that there is a statute which imposes a legal duty and the aggrieved party has a legal right under the statute to enforce its performance.

Upon an allotment made on 29.12.1953, the Governor of East Bengal executed a lease deed, being Deed No. 4580 dated 07.06.1954, in favour of M/s L. Mullick & Co. leasing 2 acres of land comprising Plot No. 245 and 246 of Tejgaon Industrial Area, Dhaka. 5. The leased property was duly mutated in the name of M/s L. Mullick & Co. with the concerned authorities, and late Ghulam Rahman Mullick began to possess and occupy the same upon payment of all rents and levies applicable thereto. He built a textile industry on the land leased to him under the name and style of Mullick Textiles Industries.”
