This appeal is directed against the order dated 03.11.2021 passed by the Nari-O-Shishu Nirjatan Daman Tribunal No. 07, Chattogram in Nari-O-Shishu Nirjatan

Case No. 277 of 2021, arising out of Panchlaish Model Police Station Case No. 42 dated 24.11.2020, corresponding to G.R. Case No. 745 of 2020 under section 11(Ga) of the Nari-O-Shishu Nirjatan Daman Ain, 2000 (as amended in- 2003) and thereby framing of charge against the accused- appellant under section 11(Ga) of the Nari-O-Shishu Nirjatan Daman Ain, 2000 (as amended in-2003).

At the time of admission this appeal, the Court was pleased to stay all further proceedings of the aforesaid Nari-O-Shishu Nirjatan Case till to disposal of this

Appeal.

For disposal of this Appeal, the relevant facts may briefly be stated as follows:

That one Anjuman Ara (Sneha) as complainant filed a petition of complaint on 17.11.2020 being Nari- O-Shishu Petition Case No. 297 of 2020 before the learned Nari-O-Shishu Nirjatan Daman Tribunal No. 7, Chattogram under section 11(Ga)/30 of the Nari-O- Shishu Nirjatan Daman Ain, 2000 (as amended in-2003) alleging inter alia that the complainant got married with the accused-appellant Mohammad Borhan Uddin on 17.02.2018. The complainant alleged that the accused- appellant demanded Tk. 10,00,000/- (Taka Ten lac) from her as dowry. On the date of occurrence dated

14.11.2020 at around 6.00 a.m. accused-appellant came to the house of complainant and created a pressure upon her for the aforesaid dowry amount and being refused she was assaulted by her husband, the accused-appellant. Hence the instant case was filed.

After  investigation,  the  police  has  submitted  the charge sheet against the accused-appellant under section 11(Ga) of the Nari-O-Shishu Nirjatan Daman Ain, 2000 (as amended in-2003). On being transferred the case has registered as Nari-O-Shishu Case No. 277 of 2021 and subsequently the charge was framed against the accused- appellant on 03.11.2021 under section 11(Ga) of the Nari- O-Shishu Nirjatan Daman Ain, 2000 (as amended in-2003). Being aggrieved, the accused-appellant preferred the instant appeal before this Court.

Mr. A.B.M. Shahjahan Akanda, the learned Advocate for the appellant mainly submits that in violation the provision of section 27 of the Nari-O- Shishu Nirjatan Daman Ain, 2000 (as amended in-2003) the learned Tribunal took cognizance of the instant case directly which is illegal and not sustainable in law and as such the order of framing charge against the accused- appellant is illegal and liable to be set aside.

He further contended that as per FIR, police report and the impugned order it is evident that no medical certificate has been submitted before the Trial Court and as such the order of framing charge dated 03.11.2021 is also liable to be set aside.

As against this, Ms. Salina Akter Chowdhury, the learned Advocate for the opposite party No. 2 submits that after compliance of all legal formalities the learned Tribunal took the cognizance of the instant case and thereby framing of charge against the accused-appellant under section 11(Ga) of the Nari-O-Shishu Nirjatan Daman Ain, 2000 (as amended in-2003). Since, there is no error of law and as such the instant appeal is liable to be dismissed.

Heard the submissions of the learned Advocates of both sides and perused the materials on record thoroughly.

The only issue for determination of the Appeal is to see whether the impugned order dated 03.11.2021 passed by the learned Tribunal in Nari-O-Shishu Case No. 277 of 2021 is liable to be set aside.

In order to appreciate the contention of the learned Advocate of both the parties it is necessary to examine


the relevant provision of section 27 of the Nari-O-Shishu Nirjatan Daman Ain, 2000 (as amended in-2003) which

reads as follows:

In the instant case, the complainant filed a

petition of complaint on 17.11.2020 against the accused-appellant and others under section 11(Ga)

and 30 of the Nari-O-Shishu Nirjatan Daman Ain,

2000 (as amended in-2003) before the learned Nari-

O-Shishu Nirjatan Daman Tribunal No. 07, Chattogram. After examination of the complainant,

the learned Tribunal passed an order dated 17.11.2020 which reads as follows:

After having an inquiry police submitted a

charge sheet dated 06.03.2021 against the accused-

appellant under section 11(Ga) of the Nari-O-Shishu

Nirjatan Daman Ain, 2000 (as amended in-2003).

Subsequently, the date was fixed on 04.10.2021 for

taking cognizance. After hearing of both parties, the

learned Tribunal took the cognizance of the case

instant case against the accused-appellant under

section 11(Ga) of the Nari-O-Shishu Nirjatan Daman

Ain, 2000 vide its order dated 04.10.2021. The

relevant portion of the said order reads as follows:

Subsequently, upon hearing of both parties the

learned Tribunal framed charge against the accused-

appellant on 03.11.2021 under section 11(Ga) of the Nari-O-Shishu Nirjatan Daman Ain, 2000.

On perusal of all the aforesaid orders it is crystal

clear that the learned Tribunal after compliance of all

legal formalities took cognizance of the instant case

on the basis of the police report dated 06.03.2021. On

perusal of the petition of complaint, police report as

well as the impugned order it appears that there is a

prima facie case against the accused-appellant which

needs to be decided by the trial Court. The other

contentions as raised by the accused-appellant are

matter of evidence.

In such view of the aforesaid legal position, we do not find any error of law.

Having regard to the aforesaid facts and circumstances of the case and the reasons as stated above we do not find any substances of this appeal.

Accordingly, the appeal is dismissed.

The order of stay granted earlier by this Court is hereby stand vacated.

The learned Nari-O-Shishu Nirjatan Daman Tribunal No. 07, Chattogram is hereby directed to dispose of the aforesaid Nari-O-Shishu Case No. 277 of 2021 expeditiously in accordance with the law.
