When the matter is taken up for hearing, Mr. Md. Ahia, the learned Advocate for the applicant appearing before this Court, submits that he has instructions from his client not to proceed with this Rule and, accordingly, he prays for discharging the Rule for non-prosecution.
Therefore, the Rule is discharged for non-prosecution.
