Let a Rule be issued calling upon the opposite party to show cause as to why the accused-petitioner should not be enlarged on bail in connection with Biman Bandar Police Station Case No.21 dated 12.11.2023 corresponding to G.R. Case No.449 of 2023 under Section 25B(1)(b) of the Special Powers Act, 1974, now pending in the Court of learned Chief Metropolitan Magistrate, Amoli Adalat-1, Dhaka and/or pass such other or further order or orders as to this Court may seem fit and proper.
The Rule is made returnable within 6(six) weeks from date.
It has been alleged that 6 pieces of gold bars like material of 969 gram weight were found in the shoes of the petitioner.
The accused petitioner has specifically mentioned in the at Paragraph No.2 of the Supplementary Affidavit that he does not claim the ownership of the seized gold bars nor he would ever raise any claim over the same.
As such the Investigating Officer is directed to deposit the seized gold bars to the Bangladesh Bank at once.
Pending disposal of the Rule, let the accused petitioner Younus, son of Islam Shaikh be enlarged on ad-interim bail till disposal of the Rule on furnishing bail bond to the satisfaction of the learned Chief Metropolitan Magistrate, Amoli Adalat-1, Dhaka. The concern Court is at liberty to cancel the bail, if the accused-petitioner misuses the privilege of bail.
Let this matter be placed in the list for hearing on 07.05.2024.
