The supplementary affidavit do form part of the main application. The delay of 201 days in filing criminal revision is condoned. Records be called for.
Let a Rule be issued calling upon the opposite party to show cause as to why the judgment and order of conviction and sentence dated 08.02.2024 passed by the Additional Sessions Judge, Court No. 2, Rajbari in Criminal Appeal No. 03 of 2020 disallowing the appeal and thereby affirming the judgment and order of conviction and sentence dated 06.11.2018 passed by the Senior Judicial Magistrate, Court No. 1, Rajbari in T.R. Case No. 771 of 2014 corresponding G.R No. 114 of 2011 arising out of Pangsa Police Station Case No. 12 dated 21.05.2011 convicting the accused-petitioner under Section 457 of the Penal Code, 1860 and sentencing him to suffer rigorous imprisonment for 03(three) years and also to pay a fine of Tk. 5,000(five thousand) in default to suffer simple imprisonment for 06(six) months more should not be set aside and/or such other or further order or orders passed as to this Court may seem fit and
proper.
The Rule is made returnable within 4(four) weeks from date.
Let the realization of fine be stayed.
Let the convict-petitioner Alamin, son of Islam be enlarged on bail for 6(six) months from the date on furnishing bail bond to the satisfaction of the Additional Sessions Judge, Court No. 2, Rajbari.
