appeared on behalf of the convict-petitioner and the learned Deputy Attorney General Mr. Md. Emran Khan who appeared on behalf of the State.
The delay of 253 days in filing criminal revision is condoned. Records be called for.
Let a Rule be issued calling upon the opposite party to show cause as to why the judgment and order of conviction and sentence dated 25.10.2023 passed by the Senior Sessions Judge, Kishoreganj in Criminal Appeal No. 359 of 2022 disallowing the appeal and thereby affirming the judgment and order of conviction and sentence dated 28.08.2022 passed by the Senior Judicial Magistrate, Court No.04, Kishoreganj in C.R. Case No. 303(1) of 2020 and CJM Case No. 751 of 2021 convicting the petitioner under Section 3 of the Dowry Prohibition Act, 1980 and sentencing him to suffer rigorous imprisonment for 01 year and 6 months should not be set aside and/or such other or further order or orders passed as to this Court may seem fit and proper.
The Rule is made returnable within 4(four) weeks from date.
The learned Advocate for the convict-petitioner submits that the convict-petitioner shall pay the entire maintenance including the past maintenance of his daughter Faujia now aged about 6 years who is residing along with the complainant within three months from date.
Considering the submission of the learned Advocate for the convict-petitioner, I am inclined to enlarge the convict-petitioner on bail for 3(three) months.
Let the convict-petitioner Shariful Islam, son of Md. Chan Miah be enlarged on bail for a period of 3(three) months from the date on furnishing bail bond to the satisfaction of the Senior Sessions Judge, Kishoreganj.
The convict-petitioner is directed to file an affidavit of compliance before expiry of the bail granted by this Court.
