on behalf of the convict-petitioner and the learned Deputy Attorney General Mr. Md. Emran Khan who appeared on behalf of the State.
Let a Rule be issued calling upon the opposite parties to show cause as to why the impugned order dated 11.07.2024 passed by the Joint Sessions Judge, Court No. 1, Mymensingh rejecting an application for bail filed under Section 426(2A) of the Code of Criminal Procedure, 1898 for preferring appeal against the judgment and order of conviction and sentence dated 08.05.2024 passed by the Joint Sessions Judge, Court No. 1, Mymensingh in Sessions Case No. 1524/2022 arising out of CR Case No. 48/2022 (Trishal) convicting the petitioner under Section 138 of the Negotiable Instruments Act, 1881 and sentencing him thereunder to suffer simple imprisonment for 01(one) year and to pay a fine of Tk. 12,00,000 (twelve lakh) only should not be set aside and/or such other or further order or orders passed as to this Court may seem fit and proper.
The Rule is made returnable within 4(four) weeks from date.
Let the convict-petitioner Hafizul Islam, son of late Taleb Ali be enlarged on bail for a limited period of 2(two) months from the date on furnishing bail bond to the satisfaction of the Joint Sessions Judge, Court No. 1, Mymensingh.
Let the Rule appear in the daily cause list for order on 05.11.2024.
