appeared on behalf of the convict-petitioner and the learned Deputy Attorney General Mr. Md. Emran Khan who appeared on behalf of the State.
Let a Rule be issued calling upon the opposite parties to show cause as to why the impugned order dated 18.08.2024 passed by the Joint Sessions Judge, Court No. 1, Dhaka rejecting an application for bail filed under Section 426(2A) of the Code of Criminal Procedure, 1898 for preferring appeal against the judgment and order of conviction and sentence dated 25.04.2024 passed by the Joint Sessions Judge, Court No. 1, Dhaka in Sessions Case No. 359 of 2022 arising out of C.R. Case No. 503 of 2021 convicting the petitioner under Section 138 of the Negotiable Instruments Act, 1881 and sentencing him thereunder to suffer simple imprisonment for 10(ten) months and to pay a fine of Tk. 35,00,000(thirty five lakh) only should not be set aside and/or such other or further order or orders passed as to this Court may seem fit and proper.
The Rule is made returnable within 4(four) weeks from date.
Let the convict-petitioner Md. Younus, son of Munsur Ali
Hawladar be enlarged on bail for a limited period of 2(two) months from the date on furnishing bail bond to the satisfaction of the Joint Sessions Judge, Court No. 1, Dhaka.
