The delay of 610 days in filing criminal revision is condoned. Records be called for.
Let a Rule be issued calling upon the opposite party to show cause as to why the impugned judgment and order of conviction and sentence dated 25.10.2022 passed by Session Judge, Khulna in Criminal Appeal No. 107 of 2022 in dismissing the same and upholding the judgment and order of conviction and sentence dated 13.08.2017 passed by the Senior Judicial Magistrate, Court No. 3, Khulna in G.R. case No. 93 of 2011 (Digholia) convicting the petitioner under table 7(ka) of section 19 (1) of the Madok Drobya Niontron Ain, 1990 sentencing him to suffer rigorous imprisonment for 8(eight) months and also passed an order to pay fine of Tk. 5,000, in default, another 1(one) month sentence should not be set aside and/or such other or further order or orders passed as to this Court may seem fit and proper.
The Rule is made returnable within 4(four) weeks from date.
Let the realization of fine be stayed.
Let the convict-petitioner Mahabub Mollik, son of late Shukur Mollik be enlarged on bail for 6(six) months from the date on furnishing bail bond to the satisfaction of the Session Judge, Khulna.
