appeared on behalf of the convict-petitioner and the learned Deputy Attorney General Mr. S.M. Golam Mostofa Tara who appeared on behalf of the State.
The delay of 280 days in filing criminal revision is condoned. Records be called for.
Let a Rule be issued calling upon the opposite party to show cause as to why the judgment and order of conviction and sentence dated 05.04.2023 passed by the Court of Additional Sessions Judge, First Court, Jhenaidah in Criminal Appeal No. 222 of 2021 modified and affirming the judgment and order of conviction and sentence dated 28.07.2019 passed by the Senior Judicial Magistrate, Second Court, Jhenaidah in C.R. Case No. 455 of 2018 convicted the petitioner under Sections 406/420 of the Penal Code and sentenced him to suffer rigorous imprisonment for 3(three) years and also pay a fine of Tk. 5,000 in default to suffer imprisonment for 3(three) months more modify the sentence under Section 420 of the Penal Code and sentenced him to suffer rigorous imprisonment for 3(three) years and also pay a fine of Tk .5,000 in default to suffer imprisonment for 3(three) months more should not be set aside and/or such other or further order or orders passed as to this Court may seem fit and proper.
The Rule is made returnable within 4(four) weeks from date.
Let the realization of fine be stayed.
Let the convict-petitioner Md. Abdul Wadud, son of late Bazlur Rahman Biswas be enlarged on bail for 6(six) months from the date on furnishing bail bond to the satisfaction of the Senior Judicial Magistrate, Second Court, Jhenaidah.
The office is directed to serve the notice upon the opposite party by usual course as well as registered post with acknowledgment receipt.
The convict-petitioner is directed to put in the requisites forthwith.
