Let a Rule be issued calling upon the opposite party 19.05.2024
to show cause as to why the accused-petitioner should not be enlarged on bail in G.R. No.323 of 2023 arising out of Ukhia Police Station Case No.47 dated 21.06.2023 under Sections 302/34 of the Penal Code, 1860, now pending in the Court of learned Chief Judicial Magistrate, Cox’s Bazar and/or pass such other or further order or orders as to this Court may seem fit and proper.
The Rule is made returnable within 06(six) weeks from date.
Pending disposal of the Rule, let the accused petitioner Abdus Shukkur son of late Ali Akbor be enlarged on ad-interim bail till disposal of the rule on furnishing bail bond to the satisfaction of the Court of learned Chief Judicial Magistrate, Cox’s Bazar.
The Officer in Charge Ukhia, Police Station, Cox’s Bazar, is directed to receive the petitioner from the jail gate and handover him to the concern Rohingya Camp. The concern Court is at liberty to cancel the bail, if the accused-petitioners misuse the privilege of bail.
