02.09.2024 Heard the learned Advocate Mr. Md. Abul Khair Khan who
appeared on behalf of the convict petitioner and the learned Deputy Attorney General Mr. Md. Emran Khan who appeared on behalf of the State.
Let a Rule be issued calling upon the opposite party to show cause as to why the order dated 18.08.2024 passed by the Joint Sessions Judge and Artha Rin Adalat, Mymensingh rejecting the application for bail filed under section 426(2A) of the Code of Criminal Procedure, 1898 for preferring appeal against the judgment and order of conviction and sentence dated 24.03.2024 passed by Joint Sessions Judge and Artha Rin Adalat, Mymensingh in Sessions Case No. 09 of 2023 arising out of C.R. Case No. 285 of 2022 (Valuka) convicted the petitioner under section 138(1) of the Negotiable Instruments Act, 1881 and sentencing him to suffer simple imprisonment for 01(one) year and to pay a fine of Tk. 55,00,000 (fifty five lakh) should not be set aside and/or pass such other or further order or orders as to this court may seem fit and proper.
The Rule is made returnable within 4(four) weeks from date.
Let the convict-petitioner, Md. Abu Bakr Siddique son of Md. Abul Khair khan be enlarged on bail for a limited period of 02(two) months from the date on furnishing bail bond to the satisfaction of the Joint Sessions Judge and Artha Rin Adalat, Mymensingh.
Let the Rule appear in the daily cause list for order on 03.11.2024.
