28.08.2024 Heard the learned Advocate Mr. Md. Saiful Islam who appeared
on behalf of the convict petitioner and the learned Assistant Attorney General Md. Syed Bashir Hossain Chowdhury who appeared on behalf of the State.
Let a Rule be issued calling upon the opposite party to show cause as to why the impugned order dated 06.06.2024 passed by Joint Sessions Judge, Court No. 1, Jamalpur rejecting the application for bail filed under section 426(2A) of the Code of Criminal Procedure, 1898 for preferring appeal against the judgment and order of conviction and sentence dated 21.04.2024 passed by the Joint Sessions Judge, Court No.1, Jamalpur in Sessions Case No. 526 of 2022 arising out of C.R. Case No. 280(1) 2022 under Section 138 of the Negotiable Instruments Act, 1881 convicting the petitioner under section 138 of the Negotiable Instruments Act, 1881 and sentencing him to suffer simple imprisonment for a period of 1(one) year and to pay a fine of Tk. 72,00,000(seventy two lakh) should not be set aside and/or pass such other or further order or orders as to this court may seem fit and proper.
The Rule is made returnable within 4(four) weeks from date.
Let the convict-petitioner, Md. Abdul Al Motin(Moyna) son of Md. Abdul Wahed (Holte) be enlarged on bail for a limited period of 02(two) months from the date on furnishing bail bond to the satisfaction of the Joint Sessions Judge, Court No.1, Jamalpur.
