Let a Rule issued calling upon the opposite-party to show case as to why the judgment and order dated 24.05.2023 passed by Additional Sessions Judge, First Court, Faridpur in Criminal Appeal Case No. 295 of 2020 affirming the judgment and order of conviction dated 02.12.2020 passed by Senior Judicial Magistrate, First Court, Faridpur in Boalmari G.R. Case No. 03 of 2018 (T.R- 23 of 2018) arising out of Boalmari Police Station Case No. 03 dated 04.01.2018 under Table 7(Ka) of sections 19 (1) of the and sentencing the convict- petitioner to suffer rigorous imprisonment for a period of 01 (one) year and to pay fine of Tk. 1,000(one thousand), in default, to suffer imprisonment for 15 (fifteen) days more should not be set aside and/or pass such other or further order or orders as to this Court may seem fit and proper.
The Rule is made returnable within 4(four) weeks from
date.
Pending hearing of the Rule, the realization of fine be stayed.
Let the convict-petitioner, Panna Begum wife of Md. Shahidul Sheikh be enlarged on bail to the satisfaction of the Additional Sessions Judge, First Court, Faridpur for 06(six) months from date.
The office is directed to serve the notice upon the opposite parties by usual course as well as registered post with acknowledgment receipt.
The convict petitioner is directed to put in the requisites forthwith.
