28.08.2024 Heard the learned Advocate Mr. Md. Akramul Islam who
appeared on behalf of the convict petitioner and the learned Assistant Attorney General Md. Syed Bashir Hossain Chowdhury who appeared on behalf of the State.
Let a Rule be issued calling upon the opposite party to show cause as to why the order dated 11.08.2024 passed by the Joint Sessions Judge, Court No.2, Chuadanga rejecting the application for bail filed under section 426(2A) of the Code of Criminal Procedure, 1898 for preferring appeal against the judgment and order of conviction and sentence dated 23.05.2024 passed by Joint Sessions Judge, Court No.2, Chuadanga in Sessions Case No. 726 of 2023 arising out of C.R. Case No. 239 of 2023 (Damurhuda) convicted the appellant under section 138 of the Negotiable Instruments Act, 1881 and sentencing him to suffer simple imprisonment for 01(one) year and to pay a fine of Tk. 13,50,000(thirteen lakh fifty thousand) should not be set aside and/or pass such other or further order or orders as to this court may seem fit and proper.
The Rule is made returnable within 4(four) weeks from date.
Let the convict-petitioner, Most. Salma Begum wife of Dablu Mia be enlarged on bail for a limited period of 02(two) months from the date on furnishing bail bond to the satisfaction of the Joint Sessions Judge, Court No.2, Chuadanga.
Let the Rule appear in the daily cause list for order on 28.10.2024.
