Let a Rule be issued calling upon the opposite-party to show cause as to why the impugned judgment and order dated 18.10.2023 passed by Additional Sessions Judge, Court No.2, Chandpur in Criminal Appeal No. 308 of 2021 affirming the judgment and order of conviction and sentence dated 28.10.2019 passed by Senior Judicial Magistrate, Court No.02, Chandpur in G.R. No. 11 of 2017 arising out of Matlab Dakshin
Police Station Case No.11 dated 19.01.2017 convicting the petitioner under table 9 (Ka) of section 19(1) of the and sentenced him thereunder to suffer simple imprisonment for 6(six) months should not be set aside and/or pass such other or further order or orders as to this Court may seem fit and proper.
The Rule is made returnable within 4(four) weeks from date.
Let the convict-petitioner, Md. Mamun Hosen Mridha son of Late Ali Miah Mridha be enlarged on bail to the satisfaction of the Senior Judicial Magistrate, Court No.2 Chandpur for 06(six) months from date.
The office is directed to serve the notice upon the opposite parties by usual course as well as registered post with acknowledgment receipt.
The convict petitioner is directed to put in the requisites forthwith.
